Terms of Use & End User License Agreement for Snip

These Terms are a binding agreement between you and Ilya Razuvaev, an independent developer ("I," "me," the "Developer"), for the Snip app for iOS and macOS, distributed on the App Store and the Mac App Store (app id 1561559135). Please read Section 12 (Apple terms) and Section 13 (governing law and disputes).
This agreement is between you and me only, not Apple.
1. Acceptance
By downloading, installing, or using Snip on iPhone, iPad, or Mac, you agree to these Terms and to the Privacy Policy, which is part of them. If you don't agree, don't use the app. If you use it for an organization, you confirm you can bind that organization.
2. License
I grant you a limited, non-exclusive, non-transferable, revocable license to use the app on any Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms (the "App Store Terms"), including via Family Sharing where enabled. The app is licensed, not sold.
You may not: copy, modify, or create derivative works of the app; distribute, sublicense, lease, rent, or sell it; reverse engineer, decompile, or disassemble it, or try to derive its source code, algorithms, or models; or remove proprietary notices. EU exception: where mandatory law (e.g. the EU Software Directive) permits, you may decompile to the limited extent needed for interoperability.
All rights not granted are reserved. The app, its software, and its machine-learning models are protected by copyright and other IP laws.
3. How Snip Works
Snip is an AI-assisted image editor: background removal, object erase (inpainting), AI upscaling/enhancement, and OCR (text recognition). On iOS, the app can also capture photos with your camera and read or save images from your photo library.
Where processing happens depends on the platform:
- On macOS, all processing runs locally on your device. The app does not upload your images or recognized text.
- On iOS, some features — background removal, enhance, and object erase — send your image to my servers (and the providers behind them) for processing; OCR runs on-device.
How data is handled — including what is sent, to whom, and what is never sent — is described in the Privacy Policy.
4. Your Content
You keep all rights in your content — the images you provide ("Inputs") and the results Snip produces ("Outputs").
- I claim no ownership and acquire no license to your content. On macOS, processing is on-device, so I don't receive your content; on iOS, images sent for cloud processing are handled as described in the Privacy Policy and are not used to train models.
- You're responsible for your content. You confirm and warrant you have all rights needed to use, edit, and (on iOS) upload every image you put into the app, and that doing so infringes no one's IP, privacy, or publicity rights, and breaks no law.
- AI limits. Outputs come from automated processes and may contain errors or artifacts. Review and verify them before relying on or sharing them, and make sure your use of them is lawful.
5. Acceptable Use
You may not use Snip — whether processing runs on-device (macOS) or in the cloud (iOS), and including any image you upload — to create, edit, or distribute illegal content or content that violates others' rights. In particular, you must not use it to:
- Create non-consensual intimate imagery or sexual deepfakes — you may not produce or alter intimate or sexually explicit depictions of an identifiable real person without their consent, including realistic AI-altered ones. This is consistent with the US TAKE IT DOWN Act and state deepfake/NCII laws. Sexually explicit depictions of minors in any form are strictly prohibited and may be reported to authorities.
- Produce deceptive or harmful deepfakes to harass, defraud, defame, impersonate, intimidate, harm, or interfere with elections, where prohibited by law.
- Process someone's image, face, or biometric data without their consent where consent is legally required.
- Infringe IP or process protected works without authorization.
- Violate privacy or publicity rights.
- Create unlawful, fraudulent, defamatory, harassing, hateful, or violent content, or content that exploits or endangers minors.
- Circumvent the app's licensing, free-tier limits, or technical protections.
You're solely responsible for compliance. I may suspend or terminate your license for violations (Section 15).
6. AI Disclaimer; "AS IS"
The app and all Outputs are provided "AS IS" and "AS AVAILABLE," with all faults — whether processing runs on-device (macOS) or in the cloud (iOS). To the maximum extent permitted by law, I disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. I don't warrant that any feature (background removal, erase, upscaling, OCR) will be accurate or error-free, that Outputs will be free of artifacts, or that the app will run uninterrupted or stay compatible with future OS versions.
Snip is a creative and productivity tool. Do not rely on it in any medical, legal, forensic, financial, safety-critical, or other high-stakes context. Verify any Output before relying on it. Some jurisdictions don't allow certain warranty exclusions; there, any mandatory warranties are limited to the minimum the law allows.
7. Limitation of Liability
To the maximum extent permitted by law:
- I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business.
- My total liability for all claims will not exceed the greater of (a) US$10.00 or (b) what you actually paid for the app and in-app purchases in the 12 months before the claim.
Carve-out. Nothing here excludes liability that can't be excluded by law — for example death or personal injury from negligence, fraud, or non-waivable consumer rights (including in the EU and UK). Where such law applies, these limits apply only as far as that law allows.
8. Indemnification
To the maximum extent permitted by law, you'll defend and indemnify me against claims, damages, and costs (including reasonable legal fees) arising from: your content and your use of the app with it; your breach of these Terms (including Section 5); or your violation of any law or third-party rights. This doesn't apply to the extent a claim arises from my own willful misconduct, or where indemnification by a consumer is limited by mandatory law.
9. Subscriptions, Lifetime, and Billing
Snip has a free tier and paid options, all transacted through Apple via StoreKit and managed with Apphud:
- Auto-renewable subscriptions — Monthly and Annual.
- Lifetime — a one-time, non-consumable purchase giving access, for the lifetime of the app, to the set of paid features available at the time of purchase, with no recurring billing. It is not a personal-lifetime guarantee, is not a promise to keep supporting any specific feature, and does not cover unrelated future products. As noted in Section 11, I may still change or remove features over time.
Free-tier limits differ by platform:
- On iOS, the free tier provides a small daily credit allowance (about 3 edits per day).
- On macOS, the free tier provides a daily edit limit enforced locally on your device.
Billing terms:
- Auto-renewal. Subscriptions renew automatically at the then-current price through your Apple ID unless you cancel at least 24 hours before the period ends.
- Manage/cancel anytime in your Apple ID / App Store settings; cancellation takes effect at the end of the current period.
- Free trials. Any unused trial portion is forfeited when you buy a subscription. If you don't cancel before a trial ends, you'll be charged.
- Price changes are handled by Apple, which will notify you and seek consent where required.
- Payments, refunds, and cancellations are handled by Apple under the App Store Terms. I don't process payments and generally can't issue refunds directly — request them from Apple (e.g. reportaproblem.apple.com). Your statutory refund/withdrawal rights are unaffected.
The exact price, period, features, and any trial are shown in the app before you confirm.
10. Free Tier
The free tier is a convenience and may have limits (a daily credit allowance on iOS, a daily edit limit on macOS). I may modify, limit, or discontinue it or any feature at any time, with notice where law requires, and may take reasonable measures against circumvention.
11. Third-Party Services and Updates
Snip relies on third-party services; your use of them is subject to their terms:
- Apple — App Store, StoreKit, iOS/macOS frameworks (App Store Terms apply).
- Apphud, Inc. — subscription management and receipt validation. Privacy: https://legal.apphud.com/privacy.
- Amplitude, Inc. — product analytics. Privacy: https://amplitude.com/privacy.
- Google LLC (Firebase Analytics) — usage analytics on macOS (see the Privacy Policy for whether this is active). Privacy: https://firebase.google.com/support/privacy and https://policies.google.com/privacy.
On iOS, background removal, enhance, and object erase are processed through my backend and the image-processing providers behind it; this and any other recipients of your data are described in the Privacy Policy. These analytics services never receive your images or recognized text. I'm not responsible for these providers' own practices and disclaim liability for them to the extent permitted by law.
I may release updates and add, change, or remove features, but I'm not obligated to provide updates or to keep supporting any particular version or feature. Continued availability isn't guaranteed.
12. Apple-Specific Terms (Required for the App Store and Mac App Store)
These terms apply because you got the app from the App Store or Mac App Store. If any conflict with the rest of this Agreement as to your use of the app, these terms control to that extent.
- Acknowledgement. This Agreement is between you and me only, not Apple, and Apple isn't responsible for the app or its content.
- Scope of License. The license is non-transferable, for use on Apple-branded products you own or control, per the App Store Terms' Usage Rules.
- Maintenance and Support. I'm solely responsible for maintenance and support. Apple has no support obligation for the app.
- Warranty. I'm solely responsible for any warranties. If the app fails to conform to a warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims are my responsibility.
- Product Claims. I, not Apple, am responsible for claims relating to the app, including product liability, regulatory non-conformance, and consumer-protection or privacy claims.
- Intellectual Property. If the app infringes a third party's IP, I, not Apple, am solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal Compliance. You confirm you're not in an embargoed or "terrorist supporting" country and not on any US prohibited-party list.
- Developer Contact. Questions or claims about the app go to Ilya Razuvaev at snipfeedback@gmail.com.
- Third-Party Terms. You must comply with applicable third-party terms (Section 11).
- Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
13. Governing Law & Disputes
If you have a dispute, please email snipfeedback@gmail.com first — most things can be resolved informally.
This Agreement is governed by the laws of England and Wales, without regard to its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods.
Nothing here removes the mandatory rights of your country of residence. If you're a consumer, you keep the consumer-protection rights of where you live that can't be waived by agreement, and EU/UK consumers may bring claims in their home courts under their home law. EU consumers may also use the European Commission's Online Dispute Resolution platform where available.
Either party may still bring a qualifying claim in small-claims court and may go to court to protect intellectual-property rights. To the maximum extent permitted by applicable law, claims must be brought individually and not as a class, collective, or representative action, and the parties waive any right to a jury trial.
14. Export Controls
You agree to comply with all applicable export and re-export control laws, including those of the United States, and not to use the app in violation of them.
15. Termination and Survival
This Agreement runs until terminated. Your rights end automatically if you breach it (including Section 5). You can terminate by deleting the app; cancel subscriptions through Apple (Section 9). Sections that should survive by their nature — including 4, 5, 6, 7, 8, 11, 12, 13, 14, 15, and 16 — survive termination.
16. General
- Entire Agreement. These Terms and the Privacy Policy are the whole agreement about the app and supersede prior ones.
- Severability. If a provision is unenforceable, the rest stays in force and that provision is narrowed or severed.
- No Waiver. Not enforcing a provision doesn't waive it.
- Assignment. You may not assign these Terms without my consent; I may assign them with a transfer of the app or my business.
- Changes. I may update these Terms; the current version is at https://sniperaser.com/terms/ with an updated date. Material changes are communicated where law requires, and continued use after they take effect is acceptance, to the extent permitted by law.
